1. GENERAL INFORMATION

These conditions of use (the “Conditions of Use”) regulate access and use of the website hosted under the domain name www.aneandgrace.com (the “Website”) and under any of the subdomains or dependent web pages of the same, as well as the content and services that the owner of the Website makes available to its users (the “Users”) and established together with the Privacy and Cookies Policy, relating to the management of the personal data of the Users , the terms and conditions by which the Website is governed.

2. PURPOSE OF THE CONTRACT

These Terms of Use make up the entire contract through which the conditions of purchase (of the products) are made available to Users by ANE & GRACE on the Website.
Access to the Website or its use by the User, as well as the purchase of any Product, infers, and without reservation, the knowledge and acceptance of these Conditions of Use, therefore, it is recommended that the User reads them carefully every time you want to buy a Product.

3. PURCHASE OF PRODUCTS

To order Products, the User must follow the purchase procedure established on the Website, read and accept these Terms of Use and select “Finish and Pay” (the “Order”). Next, ANE & GRACE will send an email to the User confirming that the Order has been accepted (the “Order Confirmation”). The contract between the User and ANE & GRACE will finally be formalized once ANE & GRACE sends the User the Confirmation of purchase. Only those Product (s) indicated in the Order will be the object (s) of the contract.

4. PRODUCT AVAILABILITY

All product orders are subject to availability and, in this regard, if there are difficulties in the supply of products or if there are no items in stock, we will reimburse any amount that you may have paid.

We reserve the right to withdraw any Product from this website at any time and / or to remove or modify any material or content thereof.

5. REFUSAL TO PROCESS AND ORDER

Although ANE & GRACE will do its best to process all Orders, there may be exceptional circumstances that force them (ANE & GRACE) to reject the processing of an Order after sending the Order Confirmation, for which reason ANE & GRACE reserves the right to do so at any time.

ANE & GRACE reserves the right to remove any Product from the Website at any time and to remove or modify any material or content thereof. ANE & GRACE is not liable to the User or to any third party for the removal of any Product from the Website, regardless of whether the said Product has been sold or not.

6. DELIVERY OF PRODUCTS

Once the Shipping Confirmation has been sent, the Products will be delivered to the address indicated by the User when placing the Order within approximately three to four (3-4) working days from the day of purchase to Spain, one to two (1-2) days to UAE and 6-7 business days outside of Spain.

ANE & GRACE assumes no responsibility when the delivery of the Product does not take place as a result of the data provided by the User being false, inaccurate or incomplete or when the delivery cannot be made for reasons beyond the control of the shipping assigned company, such as the absence of the User or the retaining of the Product in Customs.

Delivery times are approximate, although ANE & GRACE tries to adjust to them accordingly.

7. PRICE AND PAYMENT OF THE PRODUCTS

The prices applicable to each Product are those published on the Website on the date the User places the Order. Despite the fact that ANE & GRACE tries to ensure that all the prices listed on the Website are correct, errors may occur. In the event that ANE & GRACE discovers an error in the price of any of the Products that a User has requested, it will inform you as soon as possible and give you the option to reconfirm the Order at the correct price or to cancel it. If ANE & GRACE fails to contact the User, the Order will be considered canceled and the User will be fully reimbursed for the amount paid.

ANE & GRACE is not obliged to supply the User with any Product sold at the wrong or lower price (even if the Shipping Confirmation has been sent), if the error in the price is obvious and unequivocal and could have been reasonably recognized by the User as an incorrect price.

Prices can change at any time. However, possible changes will not affect the prices of products once ANE & GRACE has sent the Shipping Confirmation.

8. VALUE ADDED TAX (VAT)

The applicable VAT rate will be the one legally in force at any given time depending on the specific product in question.

9. RETURNS AND EXCHANGES OF PRODUCTS

Right of withdrawal
In accordance with the applicable regulations, in the event that the User is buying as a consumer, he/she may withdraw from the contract (except in the cases established by law) and freely return or exchange the Products delivered at any time within the period of 30 calendar days from the date of delivery (the “Withdrawal Period”). 10. INDUSTRIAL PROPERTY

Trademarks, trade names, store signs, names, logos, slogans or any type of distinctive sign shown on the Website and belonging to ANE & GRACE, and in particular, the name ” ANE & GRACE “, may not be used, without prior written permission of ANE & GRACE.

11. LINKS FROM OUR WEBSITE

In the event that our website contains links to other websites and materials of third parties,such links are provided for information purposes only, without us having any control over the content of said web pages or materials. Therefore, we accept no liability for any damage or loss arising from its use.

12. DISCLAIMER OF LIABILITY

ANE & GRACE is cleared from any responsibility related to:

• The operation of the Website, (including causes of force majeure, or any other interruptions beyond the control of ANE & GRACE), that may not be fully operational, or is lacking in functionality to manage the relevant service.
• Possible errors or security deficiencies that may occur due to the use, by the Users, of a browser of an outdated or insecure version, as well as the activation of the devices for keeping passwords or identification codes of the registered User in the browser, or damages, errors or inaccuracies that may arise from its malfunction.
• For direct or indirect damages that may be caused by the information transmitted or communicated on the Website or in its electronic communications, including technical limitation or human errors in the published data.
• Damages, including but not limited to: direct or indirect, inherent or consequential damages, losses or expenses, arising in relation to this Website or its use or impossibility of use by any of the parties, or in relation to with any performance failure, error, omission, interruption, defect, delay in operation or transmission, computer virus, system or line failure.

The User will be liable for damages of any kind due to illegal or fraudulent acts, as well as those damages that ANE & GRACE or its Users may suffer as a direct or indirect consequence of the User’s breach of these Conditions of Use, reserving ANE & GRACE those actions to which it is entitled before the relevant judicial or police authorities.

Although it uses its best efforts, ANE & GRACE cannot guarantee Users continued and uninterrupted access and use of its Website.

13. MODIFICATIONS

ANE & GRACE has the right to review and modify these Conditions of Use at any time. The User will be subject to them from the moment they accept them, except if the law or government agencies states ANE & GRACE must make retrospective changes, in which case the possible changes will also affect the Orders that the User had previously requested.

The applicable regulations require that part of the information or communications that ANE & GRACE sends to the User be in writing. 15. JURISDICTION AND APPLICABLE LAW

The operation and use of the Website and these Conditions of Use are governed by UAE law. To the extent permitted by law, ANE & GRACE and the User, clearly surrender any other jurisdiction that may relate to them, and agree to submit to the jurisdiction of the Courts and Tribunals of Dubai (UAE).

ANE & GRACE has the right to review and modify these Conditions of Use at any time. The User will be subject to them from the moment they accept them, except if the law or government agencies states ANE & GRACE must make retrospective changes, in which case the possible changes will also affect the Orders that the User had previously requested.

16. ADDITIONAL INFORMATION ON THE CARE OF YOUR JEWELS.

If you follow certain cares it will expand the life of your ANE & GRACE jewel. We recommend that you remove your ANE & GRACE jewels before performing activities that could damage it, such as sports or work out. Try to avoid contacting your jewel with cosmetics and/or household products as they may contain ingredients that can damage the colour of your items.

Do not expose ANE & GRACE products to sudden temperature changes. For its proper conservation, it is preferable that you store your ANE & GRACE jewels individually in their original case, as it designed to protect your jewellery. If you choose a jeweller, try to be in a separate compartment of other pieces. Try to have the chains closed and placed flat to avoid knot formation. Do not exercise disproportionate force over your jewellery as it may cause to break it.
